LA REP – TERMS OF SERVICE

By scheduling or confirming a photoshoot with LA REP, you agree to the following terms:

1. Payment Terms

Payment is due upon delivery of the final media unless otherwise stated in writing.
Unpaid invoices may incur a 10% late fee after 15 days.
If an invoice remains unpaid after 30 days, LA REP may send the outstanding balance to collections, and the client will be responsible for all reasonable costs associated with recovering overdue payments.

2. Payment Responsibility

The party who books or confirms the shoot (agent, brokerage, designer, or representative) is responsible for full payment of the invoice. Payment is not the responsibility of the homeowner unless the homeowner directly contacted LA REP and booked the shoot themselves. If a third party fails to pay, the booking client remains fully responsible.

3. Cancellations & Rescheduling

Cancellations or rescheduling must be made at least 24 hours before the scheduled shoot time.
Bookings canceled within 24 hours may be subject to a fee up to 50% of the project cost.
Weather-related delays may be rescheduled without penalty.

4. Property Readiness

The booking client is responsible for ensuring the property is photo-ready at the time of the shoot (clean, staged, lights on, blinds open, etc.).
If the photographer must wait for access or perform staging/cleanup, additional fees may apply.

5. Licensing & Usage

LA REP grants the booking client a license to use the delivered media for marketing the property and for general promotional use.
Usage of any delivered media is contingent upon full payment.
By downloading, posting, sharing, or distributing the media, the client acknowledges that payment is due in full.
This license is non-transferable unless agreed upon in writing.
LA REP retains the right to use the media for portfolio and marketing purposes unless requested otherwise before delivery.

6. Rights Reversion for Non-Payment

If an invoice remains unpaid after 30 days, all usage rights are automatically revoked.
LA REP may request removal of the media from MLS, Zillow, social media, brokerage platforms, or any other location where the content has been used.
Unauthorized use of unpaid media may be subject to an infringement fee.

7. Safety & Access

The client must ensure safe and legal access to the property.
If the photographer cannot safely access or work on-site, the shoot may be canceled and a cancellation fee may apply.

8. Aerial (Drone) Operations

All aerial work is conducted under FAA Part 107.
Flights may be declined or adjusted due to weather, FAA restrictions, or safety considerations.

9. Delivery Timeline

Standard photo delivery is within 24–48 hours unless otherwise noted.
Video, virtual tours, or specialized edits may require additional time.
